Terms and Conditions

These terms (“Terms”) apply to those purchasing products from us, or generally using our website, our brochures or any applications that may be available (collectively referred to as the “Sites”). Further terms and conditions apply to users of The BIB Wine Club subscription service.

By using our Sites you agree that you have read and accept these Terms, which may be amended from time to time. Please read the Terms carefully prior to purchasing products from us or using our sites.

By placing an order with us you confirm that you and the recipient of the wine are at least 18 years of age. It is against the law for any person under the age of 18 to buy, or attempt to buy intoxicating liquor or for any person to buy intoxicating liquor on behalf of any person under the age of 18. If couriers are in doubt of the age of the recipient of an order they will request ID. If they are left not satisfied they will not leave the wine.

By accepting these Terms you confirm that you are 18 years of age and consent to our validating name, address, age, and other personal information supplied against third party databases. Personal information may be disclosed to a credit reference agency or fraud prevention agency who may keep a record. No credit checks are performed and any checks made are done for the sole purpose of confirming your identity.

None of these Terms affect your legal rights. If any term is deemed to be against any applicable statutory or common law, the exclusion of that term will be to the minimum extent required to comply with the law and will not affect the validity or enforceability of the remainder.

Who are we?

We are The BIB Wine Company, which is a trading name of Lea & Roberts Ltd - registered at Companies House, in England and Wales, as a Private Limited Company with registered company number 10760777 and registered address of Roxburgh Milkins Limited, Merchants House North, Wapping Road, Bristol, BS1 4RW. Our AWRS Unique Reference Number is XCAW00000109216 and our VAT Registration Number is 271 8479 70. Any references to ‘we’ or ‘us’ within these Terms refers to Lea & Roberts Ltd, trading as The BIB Wine Company.

Sales

A contract with us is only created by our accepting an order. Order acceptance is only complete and thus the contract formed, when we despatch to you the product or products ordered. Neither payment nor our acknowledgement of our receipt of your order constitutes a formed contract.

We retain the right not to accept an order for any legal reason, but may specifically do so as a result of product unavailability, inability to take or obtain authorisation for your payment, lack of verification that you are aged 18 or over, the suspicion of fraudulent use or use that we deem inappropriate or against our Terms of our Sites, or an incorrect price or product description appearing on our Sites.

All prices are quoted in pounds sterling and include UK duty and VAT unless otherwise stated. Delivery is charged additionally, with the exception of where otherwise stated on our Sites or within our Terms.

We always endeavour to show the correct price on our Sites. However, it is possible that errors may occur resulting in the incorrect pricing information being displayed for a product or the incorrect product information being displayed. Whenever we are aware of such a circumstances we will contact you prior to dispatching your product in order to seek confirmation that you still wish to order at the correct price or with the correct product details, or indeed cancel your order. Without such confirmation within 7 days we will consider this to be cancellation of your order.

We make every effort to keep our prices low and consistent but we reserve the right to alter our prices without notice due to market conditions, tax hikes (or reductions) or changes to duty, or other similar circumstances.

We reserve the right to end special offers at any time, also without notice.

It is the nature of wine that products are limited in their availability. All of our products are subject to availability. We may occasionally substitute wines for alternative vintages or similar wine of the same or greater value. Additional terms apply to customers of The BIB Wine Club.

All goods are purchased from us are for personal use only (including gifts), and may not be sold or used for commercial purposes.

Our liability for loss, damage or costs you incur as a result of our failing to comply with these Terms are limited to those that are a direct and foreseeable consequence of such failure(s).

The images used for our products are illustrative only. We make every effort to ensure their accuracy but we cannot guarantee that the colours and appearance will display accurately. Products purchased may vary.

 

Delivery

We deliver to the United Kingdom, not including overseas territories or crown dependencies, other than the Isle of Man. Unfortunately, we are not able to deliver to BFPO addresses at this time.

Taster boxes and pre-order items ship separately on the day stated. Richard Brendon glassware ships separately in 2-3 working days for UK mainland addresses.

Our standard delivery times are listed below. We will make every effort to ensure that we deliver within these time-frames.

For orders placed before 12.30pm on a working day (if later please add one working day):

  • For deliveries to mainland United Kingdom addresses (not including the Scottish Highlands or Islands) our standard delivery charge is £6.95 and is a next working day service.
Other UK delivery addresses, and deliveries to the Isle of Man are listed below:
  • For deliveries to the Scottish Highlands our standard delivery charge is £13.95 and is a 2 working day service.

  • For deliveries to the Scottish Islands our standard delivery charge is £13.95 and is a 2-5 working day service.

(Scottish Islands - HS1-9, IV40-51, IV55-56, KA27-28, KW15-17, PA20, PA41-49, PA60-78, PH42-44, ZE1-3)

  • For deliveries to Northern Ireland our standard delivery charge is £13.95 and is a 2 working day service.
  • For deliveries to the Isle of Man our standard delivery charge is £13.95 and is a 2 working day service.
  • For deliveries to the Isle of Wight our standard delivery charge is £12.50 and is a 2 working day service.
  • For deliveries to the Isles of Scilly our standard delivery charge is £15.95 and is a 2 working day service.

Free delivery applies for all shipments over £100 for postcodes that would otherwise meet the requirements for our standard £6.95 charge. Free delivery options are unfortunately not available for orders to the Scottish Highlands or Islands, the Isles of Scilly, the Isle of Man or Northern Ireland. However, for these addresses we will deduct a minimum of £6.95 from the standard delivery charge that applies to the delivery address. Discounts to shipping are applied to the basket total prior to discounts, but not including items despatched separately.

Free delivery only applies for those wishing to use the ‘standard delivery’ option. If you select any other next day or special delivery rates as may be available the full rates as displayed will be charged.

If we repeatedly find that customers are unavailable to take delivery of orders or there are reasonable circumstances to do so, we may restrict or withdraw completely, delivery services to specific customers or customer addresses.

All of our deliveries are made by third party carriers. If you leave delivery instructions the delivery driver may be able to leave your order if you are out. If not possible, or the delivery instructions are not clear or appropriate, then a card will be posted through your letterbox with instructions on how to re-arrange delivery or collect your order. If no delivery instructions are left, drivers may be required to obtain a signature or other form of proof of delivery. Please keep your delivery note and contact us immediately if your order is damaged or missing.

Money-back Guarantee

If you don't like a wine that you have purchased from us, we will gladly recommend a replacement free of charge, or refund your money including the delivery charge (as applicable). We reserve the right to ask that you send the wine that you don't like back to us, with over 80% of the wine remaining. Please contact us on info@bibwine.co.uk to arrange the refund or replacement.

Cancellations, Replacements and Refunds

You may cancel your order and/or return your goods within 7 working days of submitting your order. Please send via courier to London City Bond, Global Warehouse, Derby Street, Burton-Upon-Trent, Staffordshire, DE14 2LE. Returns are sent at your own expense and risk. We will gladly refund the full cost of the returned item(s), including the original delivery charge - refunds will be made within 30 days of receipt of items. Please contact us first by email (info@bibwine.co.uk) and quote the order details. Refunds will only be given for items returned that are in saleable condition.

If a wine purchased from us is faulty, damaged or not the wine that you ordered, please get in touch so that we can organise for a refund/replacement. We may require that you provide evidence of the fault, damage or incorrect order and that you make the wine available for collection from the address to which we delivered the wine. Such collection will be at our expense.

If you don’t enjoy the wine or suspect that it is faulty, please contact info@bibwine.co.uk and one of our team will happily assist.

None of these Terms affect your legal rights with regards to any of our products or services. More information on your legal rights can be obtained through Trading Standards or your local Citizens Advice Bureau.

Security

We constantly strive to ensure that all information is sent, received and stored using up-to-date secure software in accordance with the most recent security protocols. This includes the handling of credit card details. For more information on your privacy and data please see our Privacy Policy.

Fraud and Crime

In order to prevent, detect or assist with the prosecution of offences and/or the apprehension of offenders we reserve the right to share information with the police and other such agencies in accordance with the relevant statutory and common law. Such information will only be used for this purpose.

Force Majeure

We are not responsible for any delay in, or failure of, performance of our obligations under these Terms of Sale which arise from any event which is outside of our control. Such events may include any force majeure, industrial action, or failure of information technology or third party providers. We will always make best efforts to contact you in such circumstances in order to keep you up-to-date, make alternative arrangements where possible and reasonable and mitigate the effects. You remain entitled to cancel your order, and if you have already paid receive a full refund.

Our liability to you or any third party for loss, damage or costs which arise as a consequence of your wrong-doing, failure to handle our products in a safe and appropriate manner, or your failure to store, consume or otherwise interact with products purchased from us in an appropriate manner (see Recommendations and Warnings below). Similarly, we will not be liable for loss, damage or costs incurred as a result of spillages or breakages unless as a result of our negligence, or our products being faulty/defective in accordance with the relevant and applicable law.

Recommendations and Warnings

Our products come with a number of risks and warnings, not least in respect of their being alcoholic.

Alcohol should be consumed in moderation. Please handle in accordance with standard manual handling procedures with respect to the weight of the products being handled. Our products may stain. Always store in a cool and dark area, away from direct sunlight and do not shake or otherwise inflict unnecessary movement.

Use of our Sites

The use of our sites is strictly prohibited to anyone under the age of 18 years. By using our Sites you confirm that you are 18 years of age or over.

You may only use the Sites for lawful purposes and without infringing the rights of others or restricting or inhibiting their use and enjoyment of the Sites.

We reserve the right to withdraw our services on the Sites without notice.

Accounts

You may register an account with us voluntarily to improve your use of any of our services or may be required in order to use/purchase certain services and/or products. By registering an account with us you agree that all of the information provided is accurate, true, current and complete. You must notify us immediately of any changes to your personal information, by updating your details in your account area. You shall not impersonate any other person or entity, or otherwise misrepresent your identity.

If we suspect any such misuse or misrepresentation we reserve the right to terminate or restrict your access and use of the Sites.

Intellectual Property Rights

All present and future copyright, design rights, unregistered designs, database rights, registered and unregistered trade marks (including The BIB Wine Company, The BIB Wine Co and BIB Wine) and any other future and present intellectual property are owned by us or the applicable third party application or licensor. Nothing in these Terms shall be construed as an assignment to you of any such intellectual property rights.

Any use (including copying, reproduction, duplication, transmission, or display of the content of this website, without our express written permission) for purposes other than the viewing of information or for ordering purposes, is strictly prohibited.

User comments, content and ratings

As may be possible on our Sites, any right to post reviews, messages or any other content is given on the condition that such content not be illegal, obscene, abusive, threatening, defamatory, invasive of privacy, infringing of intellectual property rights or otherwise injurious to third parties, or objectionable.

If you disclose, submit or offer any Submissions, unless indicated otherwise, you:

  • Grant us a non-exclusive, irrevocable, perpetual, royalty-free and fully sub-licensable right to use, reproduce, publish, modify, adapt, translate, distribute, create derivative works from, and display such Submissions throughout the world in any media.
  • Grant us and all sub-licensees the right to use the name that you submit in connection with such Submissions, if we so choose.
  • Agree to waive your right to be identified as the author of such Submissions and your right to object to derogatory treatment of such Submissions.
  • Represent and warrant that you own or otherwise control all of the rights to the Submissions; that, as at the date the Submission is disclosed, submitted or offered to us, such Submission is true, accurate and not misleading; use of the Submission will not cause injury to any person or entity (including that it is not defamatory), does not include the trade secret or confidential information of others and does not infringe any other person's or entity's rights. You agree to indemnify us for all claims brought by a third party against us arising out of or in connection with a breach of any of these warranties.

These terms also govern any Submissions you make on any of our related third party websites or pages such as our Facebook page, Twitter, or other social networking sites. All comments, images, videos and any other type of material posted on any third party social networking site do not necessarily reflect the opinions or ideas of us or our employees and we are not responsible for any such content. In any event, all material posted on any third party social networking site must comply with these Terms and the third party social networking sites' terms of use, as applicable.

Privacy

Your data and privacy is important to us. We are GDPR compliant and process information about you in accordance with our Privacy Policy. By using these Sites you consent to such processing and confirm that all information provided is accurate.

Liability

We have taken all reasonable care in the preparation of the content of the Sites. However, to the extent permitted by applicable law, we do not make any representations, warranties or terms of any kind in respect of the Sites or their contents (including, without limitation, its accuracy or any views or comments made). Access to and use of the Sites and content on the Sites is entirely at your own risk. We accept no liability for viruses or other device contaminants. You are recommended to take all appropriate safeguards (such as installing appropriate anti-virus software) and firewalls before downloading content from the Sites.

We expressly exclude, to the fullest extent permitted by law, all liability of The BIB Wine Company (a Trading Name operated by Lea & Roberts Ltd), its directors, employees and other representatives, howsoever arising, for any loss or damage suffered as a result of your (i) use of, or inability to use, the Sites; or (ii) use of or reliance on any content displayed on the Sites.

All content, text and graphics on the Sites, unless specified, are directed solely at those who access the Sites from the United Kingdom (excluding the Channel Islands). We make no representation and will not be held liable for any use of the Sites by individuals who access the Sites from other locations.

Information transmitted via the Sites will pass over public telecommunication networks. We make no representation or warranty that the operation of the Sites will be uninterrupted or error free and we will not be liable to you if for any reason the Sites are unavailable at any time or for any period or if there are any errors.

The Sites may include links to websites and/or services owned and/or operated by third parties. These are provided for your convenience only. We are not responsible for and do not give any warranties or make any representations regarding any such websites and/or services, their content or your use of them.

Nothing in this section shall affect our liability for death or personal injury arising from our negligence, our liability for fraud, or any other liability which cannot be excluded or limited under applicable law.

This section does not affect or apply to our liability under Terms of Sale with regards to specific liability incurred through the sales of our products. Nothing in these Terms shall affect your legal rights as a consumer.

General

We reserve the right to suspend your use of the Sites at any time for operational, regulatory, legal or other reasons. We may terminate your use of the Sites and/or your account with us with immediate effect if you breach any of these Terms.

We may update or amend these Terms from time to time to comply with law or to meet our changing business requirements by amending this page without notice to you. You are expected to check this page from time to time to take notice of any changes made. Such changes will be effective as soon as they are posted on the Sites. By continuing to use the Sites or purchasing products or services from us, you agree to be bound by the terms of these updates and amendments.

These Terms are governed by the laws of England and the English courts shall have jurisdiction over any disputes arising under or in relation to them and any contract made under them.

We may freely transfer or assign any portion of our rights or delegate our obligations under these Terms. You are not entitled to transfer or assign, by operation of law or otherwise, any portion of your rights or delegate you obligations under these Terms without our prior written consent.

These Terms, the Privacy Policy and Cookie Policy set out the entire agreement between you and us and replace any and all prior terms, conditions, warranties and/or representations to the fullest extent permitted by law. Any delay or failure by us to exercise any right we may have under these Terms does not constitute a waiver by us of that right.
